Regretfully, from time to time, when discussion and negotiation fails, the Association has had to resort to lawyers and courts to collect outstanding fees. The general principle at work here is that if you are a regular user of our privately maintained lanes, then you are required to contribute your share. It’s called ‘unjust enrichment’ if you don’t.
In 2024 the Association had to go to court to collect outstanding dues. In October this case was heard by the Ontario Small Claims Court. They ruled in favour of the Association, and the defendant was required to pay past dues as well as our legal fees.
